1. Agreement to Terms
These Terms of Use (“Terms”) govern your access to and use of the CaseBuilder website, platform, and related services (“CaseBuilder,” “we,” “our,” or “us”). By accessing or using CaseBuilder, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree, you must discontinue use immediately.
2. Description of Service
CaseBuilder provides secure, HIPAA-aligned tools for organizing, encrypting, and managing digital case materials. The service is designed for lawful professional use, including but not limited to legal, clinical, and administrative documentation.
3. Eligibility
You must be at least 18 years of age to create an account or use CaseBuilder. By using the Platform, you represent and warrant that you are of legal age to enter into a binding contract and are not prohibited from using the Platform under any applicable law or regulation.
4. User Accounts
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to notify us immediately if you suspect any unauthorized access or use of your account. We are not liable for losses arising from compromised credentials due to user negligence.
5. Permitted Use
You agree to use CaseBuilder solely for lawful purposes and in accordance with these Terms. You will not:
- Upload or transmit content that violates privacy, intellectual property, or other legal rights.
- Attempt to access, probe, or disrupt non-public areas of the system.
- Use CaseBuilder to store or transmit malicious code or spam.
- Decompile, reverse-engineer, or otherwise tamper with the service infrastructure.
- Use the platform in a manner that could damage, disable, or impair CaseBuilder’s servers or networks.
6. Ownership and Intellectual Property
CaseBuilder and its underlying software, design, and trademarks are owned and operated by CaseBuilder (or its licensors) and are protected by intellectual property laws. You retain ownership of your uploaded content and case files. By using the service, you grant CaseBuilder a limited, non-exclusive, and revocable license to process your content solely for the purpose of providing and maintaining the service.
7. Data Privacy and HIPAA
CaseBuilder implements administrative, technical, and physical safeguards consistent with the HIPAA Security and Privacy Rules. Protected Health Information (PHI) is encrypted in transit and at rest. We do not access or share PHI except as required to operate the service or comply with law. Use of CaseBuilder does not replace your own professional or organizational HIPAA compliance obligations.
8. Payment and Subscription
Certain CaseBuilder features may require payment or a subscription plan. By purchasing a subscription, you agree to provide accurate billing information and authorize CaseBuilder (or its payment processor) to charge your selected payment method for recurring fees as described at checkout. All fees are non-refundable except where required by law.
9. Termination
We reserve the right to suspend or terminate access to CaseBuilder at any time, with or without cause or notice, for conduct that we determine violates these Terms or is otherwise harmful to the platform or other users. Upon termination, your right to use the service ceases immediately. You may request deletion of your account and associated data by contacting support@casebuilder.app.
10. Disclaimers
CaseBuilder is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, either express or implied. We do not guarantee uninterrupted or error-free operation, nor the accuracy or completeness of any output generated through the platform. To the maximum extent permitted by law, we disclaim all warranties of merchantability, fitness for a particular purpose, non-infringement, or arising from course of dealing or usage of trade.
11. Limitation of Liability
To the fullest extent permitted by law, CaseBuilder and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of data, revenue, profits, or goodwill, arising from your use or inability to use the service—even if we have been advised of the possibility of such damages. In all cases, our total liability shall not exceed the amount paid by you for use of the service in the preceding twelve (12) months.
12. Indemnification
You agree to indemnify and hold harmless CaseBuilder, its affiliates, and personnel from and against any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the service, your violation of these Terms, or your infringement of any third-party rights.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict of law principles. Any dispute arising under or relating to these Terms shall be resolved exclusively in the state or federal courts located in Brunswick County, North Carolina, and you consent to the personal jurisdiction of those courts.
14. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised “Effective Date.” Continued use of the platform after changes are posted constitutes acceptance of the updated Terms.
15. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and CaseBuilder concerning your use of the Platform and supersede any prior agreements, written or oral, relating to the same subject matter.
16. Legal Disclaimer — No Legal Advice
CaseBuilder is not a law firm and does not provide legal advice, legal representation, or substitute for consultation with a qualified attorney. The platform is a documentation and organizational tool designed to assist users in managing and structuring case materials.
Any information, analysis, summaries, or document organization produced through CaseBuilder is generated for informational and administrative purposes only and should not be relied upon as legal guidance or interpretation. Users are solely responsible for reviewing and verifying all materials and ensuring compliance with applicable laws and court procedures.
